Last night, The Woodlands Community Association (WCA), The Woodlands Association (TWA) and The Woodlands Commercial Owners Association (WCOA) all voted for a Memorandum of Understanding (MOU) concerning possible general transition procedures if/when Town Center Improvement District (TCID) annexes The Woodlands.
The vote on possible TCID annexation of The Woodlands takes place on November 6, 2007.
Please view the legal review section associated with a two page document included with the MOU . This section states. “[t]he attached MOU is a non binding document. It provides the framework for a binding legal agreement that will need to be finalized by February, 1, 2008, The legal work required to complete the formal agreement will be extensive.”
At the TCID Public Meeting/Forum on September 25 2007, Ms. Blair, Chairman of the TCID Board, gave the impression to the public that all the details of the TCID annexation of The Woodlands would be worked out before the November election. After looking at the general terms of the MOU and after realizing the MOU is not a legally binding contract, I question what purpose, other than propaganda, the Assocations’ passage of the MOU accomplished?
Do you trust your leaders to sign a legally binding document in February 2008 well after the November 6, 2007 election?
Will a legally binding Regional Participation Agreement with Houston be completed before the November 6, 2007 elections?
TCID leaders attending the Associations’ meeting were giddy after the Associations approved the MOU. Lloyd Mathews, TWA board member and TCID board member, actually jumped in the air and clicked his heels in celebration of the passage of this legally worthless document.
Individuals who voted against the MOU from the WCA board included Cheryl Tangen, Karen Booren, Deborah Sargeant and John Leftwich. Anthony Fasone, TWA board member, also voted against the MOU.
